Short-term Rentals on residential islands of Duck Key - May 2009

UPDATE: New page posted on September 2009 - A number of rental properties originally listed as short term rentals are now listed as monthly rental only or have been eliminated entirely.

Several properties remain as short term listing contrary to the county 28 day rule.

THE LAW : 28 Day Rule

Short-term rentals became a major issue in the late 1990s in Monroe County. The Duck Key Property Owners' Association and residents were very vocal and attended many Monroe County Commission meetings to voice opposition to allowing short-term rentals on Duck Key. In 1999 Monroe County decided to ban short-term (less than 28 days) rentals in unincorporated parts of Monroe County .

Violating the ordinance carries a maximum penalty of 60 days in jail and a $500 fine (“Tourists,”
pars. 2-3).

 

BACKGROUND

A recent email from Sam Schorr who works for Keys Caribbean alerted residents to short-term rentals of botel units on residential Center Island.

Good afternoon,

Duck Key residents are encouraged to attend a hearing on May 28, 2009 Thursday after 12 noon lunch recess. Code enforcement officer Kerri Walbroehl would like any interested residents of Duck Key to attend this hearing, referencing illegal weekly vacation rentals taking place at Center Island homes.

Weekly vacation rentals are becoming quite a nuisance to our quiet and tranquil island. Weekend & Weekly boaters attempting to navigate on our peaceful canals and parking their vehicles and trailers haphazardly on the side of the roadway is becoming a growing problem. This summer will be especially worse, as many long term rental properties have lost tenants as a result of the worsening economy and some property owners will be looking to make up their lost rental income.

Please contact Code enforcement Officer Kerri Walbroehl at 305.289.2516 on Wednesday May 27th to confirm the hearing date and time for Thursday May 28th. The location is the 2nd floor at the Marathon Government Center next to Tranquility Bay Resort.

There is a place for vacation rentals and it is on the other side of Truman Bridge.

UPDATE June 2 : As a result of the hearing, e-mails by Sam Schorr and other emails sent to involved parties and the efforts of Code enforcement Officer Kerri Walbroehl several residential properties no longer adverise availablity of short-term rentals.

POSSIBLE VIOLATIONS

A Google internet search on May 28, 2009 showing homes available for short-term rentals on Duck Key revealed that more than just some botel units appear/appeared to be violating Monroe County codes.

The Google search revealed at least 7 properties located on residential Duck Key that provide internet information that suggests the properties are/were available for short-term rental. They state/stated specific weekly rates and/or may indicate that the minimum stay is 7 days.

Most of the sites the properties were advertised on "vacation rental by owner" type websites. One local Marathon Realtor also displayed week rates for 3 properties.

Also several of the properties were advertised with week rates on sites with some local real estate involvement.

On May 28 this property was advertised on alwaysonvacation.com, vrbo.com, and vacationrentals.com

UPDATE : Monroe County will impose a fine of $500 for violations. As of June 2, 2009 the above webpage at alwaysonvacation.com and several other sites showed a change. The sites no longer displays a weekly rate. Monthly rate of $4500 was posted with minimum nights of 28 days.

2. A residence on Vista Drive, Center Island as of June 2, 2009 was advertised at floridavacations.com, cyberrentals.com, homeaway.com, www.holiday-rentals.co.uk,a1vacations.com, flipkey.com and pickpackgo.com. It all cases as of that date short-term rentals were available.

UPDATE : This unit was also listed on a local realtor's site with a week rate on May 28, 2009, but that site as of June 2, 2009 now shows only a monthly rate.

3. An East Seaview Circle home on Yacht Club Island was advertised on June 2, 2009 at $2400 per week to $3200 per week on flipkey.com.

UPDATE : This unit was also listed on a local realtor's site with a week rate on May 28, 2009, but that site as of June 2, 2009 now shows only a monthly rate.

4. On June 2, 2009 one half of a duplex located on Indies Dr. North, Center Island was advertised at $1440 per week to $2000 per week. The duplex was advertised on flipkey.com, pickpackgo.com, and vrbo.com .

UPDATE : This unit was also listed on a local realtor's site with a week rate on May 28, 2009, but that site as of June 2, 2009 now shows only a monthly rate.

UPDATE July 2009 : Above Property no longer advertised as short term rental

 

5. Another rental on Yacht Club Island was found on May 28 at vrbo.com (Vacation Rental by Owner). The rental lists three day rates, weekly rates, 14 night and 21 day rates, and monthly rates.

6. This home on Yacht Club is advertised on vacationrentals.com as renting by night, week and month.

7. An inland home with pool on Indies Drive, Center Island was advertised at $900 - $1200 per week on vrbo.com (Vacation Rental by Owner) on May 28. The house is also advertised on floridavacations.com. Additionally the home is listed for sale at $595,000.

 

LOCAL REALTOR

Three of the seven short-term rentals listed above were listed on a Mararthon realtor's webpage.

Monroe County realtors are aware of the 28 Day Rule. Some realtor websites post information to that effect.

"Monroe County, Florida 28 Day Rule.
The Monroe County Board of Commissioners has voted to disallow short-term rentals in most residential neighborhoods. This means we are no longer allowed to rent these homes on a weekly basis and can only rent for periods of 28 days or more."

 

The Property Manager for the realtor when asked to comment if the properties were available for short-term rentals responded, "My three units on Duck Key cannot be rented for less than month."

Information on the realtor's website for each of the three units did on May 28 display weekly rates and in one instance highlighted that the Minimum stay was weekly.

UPDATE : The above graphic was changed to monthly on June 30, 2009.

Shortly thereafter rates on the website for week stays were changed to indicate "n/a" (not applicable).

The same 3 properties are listed on flipkey.com. As of June 2, 2009 the text displayed stated , "Minimum Stay : 7". Each listing is associated with the same local Marathon realtor.

On another website, http://www.pickpackgo.com/, as of June 2, 2009 two of the realtors' aforementioned three Duck Key units display weekly rates, and are part of many rental homes listed on pickpackgo.com by the same Marathon realtor.

UPDATE July 2009 : Local realtor no longer advertise the three properties as short term rental.

 

Update July 2009 - SUMMARY OF CHANGES

The Duck Key Botel rental properties on Indies Drive North, residential homes on Indies Drive North, East Seaview Circle, Vista Drive no longer are advertised as short term rentals.

 

CODE ENFORCEMENT

Code enforcement Officer Kerri Walbroehl at 305.289.2516 (walbroehl-kerri@monroecounty-fl.gov) receives complaints on code violations for Duck Key.

 

PROPOSAL TO CHANGE RENTAL CODE

According to News-Barometer May 2009 out of Big Pine - http://newsbarometer.com/2009/05/business-community-supports-rental-proposal/,

"Members of the Lower Keys Chamber of Commerce unanimously came out in support of pursuing a possible return of short-term rentals in Monroe County . . . at a forum hosted by the organization’s board of directors."

"It will now be up to the chamber’s board whether to send a resolution to the Board of County Commissioners supporting revisiting the short-term rental ban."

"A group of business owners has been trying to drum up the support of local officials to take another look at the ban put together a plan that “protects the quality of life of the neighborhoods while giving relief to businesses”

"Boondocks Grille and Drafthouse owner Lanny Gardner, Ramrod Key, presented the board and assembled members with a proposal outlining a new vacation rental policy for the county." The plan “protects the quality of life of the neighborhoods while giving relief to businesses,” Gardner said.

The plan guarantees stricter enforcement by paying for full-time staff at no cost to the county or taxpayer.

The plan is referred to as a "quality of life protection plan".
