August 2005 - A recent article in the Key west Citizen noted that windstorm insurance increases are on the horizon. The Florida Department of Insurance authorized two homeowner rate increases in 2004 in order for Citizens Property Insurance, the insurance company of last resort, to make up a deficit of $515,000,000. Citizens and other underwriters will pass on their deficits by imposing a statewide "assessment" levy on all homeowner insurers. Rate increases could amount to as much as 54% or more if the Keys were being charged actuarially sound rates according to Citizen's Insurance. One County resident who works in the County Appraiser's Office saw her bill increase from $3,800 to $5,900. Another Keys resident saw the windstorm insurance costs increase from $6,000 to $11,000.

November - Following Hurricane Wilma, the Citizens Property Insurance Corp. board approved a 15.4-percent increase statewide and a 16.2-percent increase for the Florida Keys and other coastal areas. Citizens estimates that 130,000 insurance claims will be filed for Wilma. Another 5-percent rate increase is anticipated later in December.

An early ruling went against the plaintiffs when Monroe County Judge Payne ruled that Monroe County should be reimbursed expenses because Burstyn who was in jail at the time refused to participate in a deposition.
