Property Rights - Attorney James Mattson filed suit on
November 22, 2004 against Monroe County claiming that
plaintiffs (lot owners on Duck Key,Big Pine and
Summerland Key) " . . . have been deprived all beneficial
use of their lots." Though Mattson has filed suit for
just ten plaintiffs, who own 18 parcels of land, he
indicates that such takings have affected "some 8,000
people. This is just the tip of the iceberg."

Pacific
Legal Foundation announced its filing of a temporary
takings complaint on behalf of Big Pine property
owners against Monroe County.
"No
governmental entity, whether by design or bureaucratic
indifference, may drag its feet for years, denying
property owners the right to reasonably use their
property, without due process and a demonstrated
compelling public interest,"

There you will find
background information on the filing of a multi-plaintiff
"taking" lawsuit against Monroe County, Marathon, and
Islamorada, to obtain compensation for the Fair Market
Value on platted lots in the Keys which has be found not
to have vested rights. Co-counsels Jim Mattson and Andrew
Tobin " expect that taking claims in excess of $800
million will be filed. While this will have no impact on
lots on Duck Key if the "taking" lawsuit prevails, the
$800 million in claims would affect all
taxpayers.

to Editor in KeyNoter from Dick
Rudell of
Marathon which mentions Hawk's Cay expansion.
During a flying tour of
the Middle Keys friends ask, "What are those rows of tin
roofs down there?" His response "Having long since gotten
used to the sight, the question reminded me of just how
ugly this sight really is. Other descriptive words used
"all ticky-tacky" and "tin roofs all in a
row".

11. Tin Roofs may be
needed on Yacht Club - Fireworks gave new meaning to
words "home of the brave" - On July 13, 2004 at 9 PM
during a fireworks' aerial display rockets from Hawk's
Cay landed on Ray Pryzbyl's property and exploded. When
"the rockets red glare and the bombs bursting in air"
subsided, Ray was glad that the flag and his home were
still there.

- "Sewer systems, costs merit more caution"
"High
water costs in the Keys make the idea of re-use
attractive, until officials run the numbers on the
added expense.
This
may be a case where it's far cheaper to prescribe
native vegetation that doesn't need regular watering
in parks and parkways and forego the expense of re-use
systems. "

- "Enclosure Inspections move to Phase 2"

"Inspections
take a new form beginning June 1 in unincorporated
Monroe County. Inspections will take place prior to

intent is to identify for county records any

- In the article, "Hawk's Cay draws interest of
investigators", reporter Laurie Karnatz provides a
great deal of history on the approval for expansion of
the Hawk's Cay Resort.
"In
June 2003, Monroe County officials delivered seven
boxes of tapes, videos and documents to the FBI's Key
West office in response to a federal subpoena. . . .
Most
of the records had to do with Hawk's Cay Resort, the
sprawling condominium complex, hotel and marina on
Duck Key built by developer Pritam Singh."

Tobin, Attorney and Key Largo Wasterwater Board
Commissioner , wrote a letter to the Key Largo Free
Press, in which he stated
"
According to the FKAA, tap water contains nitogen of
3mg per Liter. Therefore treating to 10 mg per Liter
(Best Available Technology) instead of 5 mg/L (Advance
Wastewater Treatment) reduces nitrogen to 95 percent
instead of 98 percent which could be insignificant
compared to the cost/benefit." Tobin points out that
"Operating and maintaining a new AWT system is
estimated to cost 60 to 80 percent more than that for
a conventional secondary treatment facility."

Representative
Sorenson has asked state agencies to rethink and

2. Tom's
Harbor Keys for Sale at $2.9 Million - The two islands
which are southwest of Duck Key's Harbour Island are for
sale. These keys most likely were included with Duck Key
in 1832 when James Audubon described visiting a group of
islands called the Duck Keys. For more about the sale of
the Tom's Harbour Keys and some history on a fishing camp
planned for them in 1981 go to Tom's
Harbor Keys.
A website
promoting the sale of the islands provides attractive
photos and says,
"Escape
the hustle and bustle of city life, become the ruler
of your own private island empire, search for buried
treasure, conduct your own "Survivor" contest, build
the ultimate sand castle, conduct corporate retreats,
or skinny dip in complete privacy. Owning a private
island in the Florida Keys is only limited by your
imagination."
3. Club
News - The Club at Hawk's Cay has increased dues at
renewal time to $2000. Club Duck Key dues are $1000 plus
initial equity shareholder membership cost of $3000.
Shareholder membership may be sold if membership is
discontinued.

Key homes displayed a festive look ths December. Santa
toured Duck Key on Christmas Eve thanks to the Conch Key
Fire Department.

Item - Commissioners approved the Duck Key Property
Owner's Association request for the funding of mooring
buoys with the help of Commissioner Rice. Commissioners
express financial concerns should similar requests come
before them, but approval was gained thanks to
Commissioner Rice's persuasiveness. Homeowners and
homeowners associations can obtain permits for marker
buoys to delineate the 100 yards off residential
shorelines as an idle speed only zone. In addition to the
10 buoys requested by DKPOA, 54 buoys in 10 locations in
Monroe County have been approved so far. See

Cesspits permits and ROGO - The County Building Permit
Allocation System and cesspit credits may slow building
on Duck Key. A number of property owners have been
granted permits to build on Duck Key, but permit holders
are kept from starting construction because they lack a
cesspit credit. Cesspit replacement credits are becoming
hard to get in unincorporated Middle Keys . Credits are
no longer available from the Grassy Key area as that is
now part of Marathon. With a waste treatment plant
scheduled for Conch Key, cesspit credits won't be coming
from that area either for a while.
Individuals
may independently acquire a cesspit permit. More than
likely Duck Key property owners anxious to build a home
will opt to replace someone's cesspit on Duck Key at
their own expense rather than wait for replacement to
happen independently. The Credit will then be reserved
until a ROGO permit is issued. The property owner must be
in the ROGO system before a Cesspit credit may be issued.
