Cohee, President Hawk's Cay Investors, Ltd. 150 East Sample Road, Suite 200 Pompano Beach, Florida 33064   Re:   Declaration of Covenants, Conditions  and Restrictions   Dear Mr. Cohee:   On behalf of the Duck Key Property Owners Association, this letter is to outline the agreements made between us concerning the revised Declaration of Covenants, Conditions and Restrictions for the Hawk's Cay Resort development. We have had an opportunity to review the revised Declaration of Covenants, Conditions, and Restrictions and we have attached to this letter a copy of that Declaration that is acceptable to the Duck Key Property Owners Association. In consideration of your allowing our input into this Declaration, we have agreed, as an organization, to support Hawk's Cay's request for a major area development approval for their proposed expansion plans.     In consideration of our assistance in your obtaining major area development final approval, you have agreed to record the revised and approved Declaration of Covenants, Conditions and Restrictions, in the Public Records of Monroe County, Florida, upon receiving the permits that will result from the approval of your major area development plans. You have also agreed to provide us with a copy of the recorded Declaration of Covenants, Conditions, and Restrictions upon their recording.     Kindly respond at your earliest convenience with your acceptance of the above agreements.
